Man accused of using nun's PC to view porn

by The Associated Press
Thursday January 31, 2008, 10:11 AM

A civilian State Police employee is accused of sneaking into a Monmouth County church to look at pornography on a nun's computer.

Thomas G. Findler was arrested Wednesday after a custodian at Grace St. Paul Episcopal Church found Findler on a nun's computer. The custodian chased him out -- right into a police officer who happened to be nearby.

The suspect, who works in a local office for the state police, is charged with burglary and theft. Authorities suspect Findler -- who worships at Grace St. Paul -- had been sneaking into the church at night for three weeks to look at pornography.

Reached Thursday morning, Findler's father said his son was not home.

Tax on hotel porn movies??

--Denver Post

Denver- A state lawmaker wants to tax in-room adult movies ordered at hotels to help fund child sex-abuse investigations.

The current version of House Bill 1086, sponsored by Rep. Amy Stephens, R-Monument, would impose a 99-cent fee on all in-room movies ordered at hotels. Stephens, though, said she plans to narrow her proposal to apply to just adult movies.

The money would go into a fund for children's advocacy centers, which counsel sexually abused children and help police and prosecutors interview young victims. There are 14 such centers in Colorado and more than 600 nationally.

Stephens said imposing the fee on adult movies to fund child sex-abuse investigations only makes sense. "Most of our sexual predators in prison are addicted to pornography," she said.

Cathryn Hazouri, executive director of the American Civil Liberties Union of Colorado, said the bill violates the First Amendment.

"Adult entertainment is just that. Whether you like it or not, adults have the right to view it," Hazouri said.

Jailer Gave Blow Job To Inmate

Oklahoma- A 20-year-old female corrections officer is facing sex assault charges for allegedly performing oral sex on a male inmate on New Year's Eve in an Oklahoma jail.

Billie Pelley told investigators that she entered inmate Bobby Mann's cell and began kissing the 37-year-old inmate "for a while." She then advanced to servicing Mann, but "stopped after thinking about what she was doing," according to a probable cause affidavit filed earlier this month in Okfuskee County District Court.

By then, however, Pelley's encounter with Mann had already been recorded by a surveillance camera. When a dispatcher, Andrea Million, subsequently entered Cell 10, she found Pelley sitting on the side of Mann's bed.

During an interview with a sheriff's investigator, Pelley admitted the sexual contact with the prisoner, who is awaiting trial on a bomb threat count. Pelley was charged last week with forcible sodomy, a felony, since Mann was not legally "capable of giving legal consent" because he is in custody.

Prosecutors concede, however, that Mann, not surprisingly, consented to the oral sex. Pelley and Mann are pictured below in mug shots snapped by the Okfuskee County Sheriff. While Pelley quickly bonded out of jail after her arraignment, Mann remains in the Oklahoma lockup.

Woman's Naked Ass May Cost $1.4 Million

WASHINGTON - The Federal Communications Commission has proposed a $1.4 million fine against 52 ABC Television Network stations over a 2003 broadcast of cop drama NYPD Blue.

In a 2003 episode of 'NYPD Blue,' Charlotte Ross was shown naked from behind as she prepared to take a shower. As punishment, the Federal Communication Commission has proposed fining 52 ABC affiliates $1.4 million because the scene "depicts sexual organs and excretory organs -- specifically an adult woman's buttocks."

New Jersey Passing Zoning Laws to Shut Down/Regulate Adult Businesses

--NY Times

New Jersey- AS a woman in a bikini top and sweat pants walked to her car in 30-degree weather from the Stiletto nude-dancing club this month, little more than the weeds and warehouses in the shadow of the Meadowlands Sports Complex were within viewing distance.

Such isolation for a club like Stiletto is exactly what the Borough of Carlstadt wants, as its zoning laws specify that sexually oriented businesses are permitted to operate only in this industrial part of town.

An adult video store on Washington Avenue called Video Extra, with lingerie-clad mannequins in the windows, is a different story. The borough is suing to have that store, which sits next to a shoe shop and across from a popular Italian restaurant, shuttered on the grounds that it is in an area not zoned for that type of business, officials said.

Across the state more than a dozen towns have passed zoning laws to regulate sexually oriented businesses, as Carlstadt has done, according to the New Jersey State League of Municipalities. Like Carlstadt, a Bergen County borough of 6,000, many have faced challenges.

“The attempt to regulate these businesses has gone on for a very long time,” said Deborah M. Kole, a lawyer for the municipalities organization.

It is unconstitutional to completely ban sexually oriented businesses, said William J. Roseman, the Carlstadt mayor, so municipal zoning laws are “the only way we can control adult entertainment establishments from running profligate within our community.”

He said the zoning restrictions had been a success, reducing the number of sexually oriented businesses in the borough to two from six and contributing to a decline in the number of people arrested for prostitution and being drunk and disorderly.

Daniel R. Aaronson, a First Amendment lawyer based in West Palm Beach, Fla., who represents the club Hott 22 in a lawsuit against Union Township, said that the zoning laws make it so difficult for sexually oriented businesses to operate that they have the effect of keeping them out of business.

“They target these specific businesses, and that’s unconstitutional,” he said.

Last summer, East Rutherford officials made public plans to zone an industrial area near the Meadowlands for sexually oriented businesses to keep them away from schools, houses of worship and residential neighborhoods. There are no sexually oriented businesses in East Rutherford today, nor do any have imminent plans to move in, but should that change the borough will be ready, Councilman Jeffrey Lahullier said.

“If we don’t have that zoning ordinance on the book, we have no power to stop them,” he said.

Bloomingdale, in Passaic County, has taken similar pre-emptive action. The borough, which officials say has no sexually oriented businesses, passed zoning laws like Carlstadt’s last year to control them should they come to town.

“We were just trying to keep ourselves up to date on stuff,” Mayor William R. Steenstra said.

In Cherry Hill, the fight to limit sexually oriented businesses has moved into the realm of state government, where two bills introduced by Assemblywoman Pamela R. Lampitt, whose district includes Cherry Hill, have been heard in committee.

Ms. Lampitt said she introduced the bills, which would require sexually oriented businesses to post security guards to keep out minors and to notify neighborhoods of their intent to move in, after her neighbors in the Barclay Farm area expressed anxiety over an adult bookstore they said was set to open next to the neighborhood.

“It was reactionary, to be honest,” Ms. Lampitt said. “It’s not something that unless a problem arises do we think, ‘What do we need to do to fix things?’ ”

Last year the township created a district in an industrial zone in which sexually oriented businesses could operate, said Dan Keashen, a spokesman for Mayor Bernie Platt. One adult bookstore had operated in town but closed recently, and there is no word on the store that was rumored to be opening near the Barclay Farm neighborhood, officials said.

Jeff Levy, the executive director of the New Jersey Adult Cabaret Association, which represents 180 so-called exotic dancing clubs, said he resented sexually oriented businesses being banished to the corners of towns but agreed that they do not belong near schools or houses of worship.

Permitting exotic dancing clubs in specified districts is preferable to the litigation that often accompanies efforts to open them in other parts of towns, he said.

Adam Orecchio, manager of Stiletto in Carlstadt, said that since the club —which does not sell alcohol — opened in 1996, there had been no complaints from borough officials or neighboring businesses.

“We do well here,” he said. “And we’ve never heard anything from anybody in town.”

The decision to create a district for sexually oriented businesses in Carlstadt in the late 1990s was made for financial reasons, Mayor Roseman said, after a chain restaurant said it would not open in the borough because it would have to do business near a strip club that has since closed.

“The owner said to me, ‘How do I run a family restaurant when there’s a sign next door’ ” advertising sexually themed entertainment? Mr. Roseman said.

The mayor said the Video Extra store was still a headache for the borough. One Bergen County judge ordered it closed because it violated zoning laws, but another judge ruled that it could reopen, he said.

It remains too soon to gauge the effects the zoning laws may have on the towns and their sexually oriented businesses, said Mr. Levy, the cabaret association official.

“I think you will have to look back 10 years from now and say: ‘Did it work? Did we create something positive?’ ” he said. “I don’t know.”

All Memphis Sex Workers Must be Licensed

by Kathee Brewer

MEMPHIS, TN -- An ordinance that took effect January 1st requires workers at adult-oriented businesses and the owners of those businesses to be licensed annually before they’re allowed to work in Shelby County.

Bartenders, waitresses, dancers, bouncers, store clerks, movie-theater employees, and others at the county’s more than two dozen adult establishments must undergo criminal background checks and complete county license applications or change careers.

The documentation required to be submitted with a license application is similar to that required under 18 USC §2257: a certified copy of a birth certificate, multiple current photographs, a government-issued identification document (driver’s license, military ID or passport, for example) and a Social Security number. The fee for an initial employee license is $198; renewals cost a minimum of $113.

Background checks will be conducted by sheriff’s deputies and the Tennessee Bureau of Investigation. A history of prostitution, rape (including statutory rape), sexual battery, public indecency, pandering, sale or distribution of obscene materials, or other illegal activities can keep a worker or business owner from being licensed by the five-member Shelby County Adult Oriented Establishment Board.

The board’s members include a doctor, a former county employee, a local businessman, a consultant, and a former criminal-court judge.

Although the new ordinance is somewhat controversial, County Commissioner Wyatt Bunker told the city’s Fox television affiliate, WHBQ- Channel 13, “I think the county has…really stepped up to the plate” with the new rules.

myspace To Sever Porn Links

--on the web

WWW- The online social networking site MySpace announced an agreement yesterday with 49 states, excluding Texas, to protect children from Internet predators, something that experts called a good first step toward keeping young Web users safe but not a remedy to the problem.

"As the popularity of social networking sites continues to grow, the steps being taking by MySpace are essential to helping keep our young people safer online," Maryland Attorney General Douglas F. Gansler, one of the attorneys general to sign the agreement, said in a statement.

The agreement outlines a range of measures aimed at protecting teenagers who use the site, at myspace.com - and keeping those under the age of 14 from creating profiles. They include:

> Strengthen software identifying underage users;

> Retain a contractor to identify and eliminate inappropriate images;

> Allow parents to send their child's e-mail address so MySpace can restrict the child from signing in or creating a profile;

> Obtain and constantly update a list of pornographic web sites and regularly sever any links between them and MySpace

> Create a closed "high school" section for users under 18;

> Implement changes making it harder for adults to contact children;

> Dedicate resources to educating children and parents about online safety

> Provide a way to report abuse on every content page, consider adopting a common mechanism to report abuse and respond within 72 hours to abuse reports

Ernie Allen, president of the National Center for Missing and Exploited Children, praised the joint agreement as a first step.

"I don't think it's a silver bullet. I don't think there's a panacea here," he said.

But the commitment by MySpace to meet regularly to discuss potential technological solutions to these concerns was promising, Allen said. "In many ways, like so many of the other challenges we've seen on the Internet, technology is going to play a key role in solving those kinds of problems," he said.

A 2006 study by researchers at the University of New Hampshire using data from the missing children's center indicated that one in seven children is sexually solicited online, and one in 33 is subjected to aggressive solicitations, Allen said.

MySpace is the largest social networking site, but the attorneys general called on others in the industry to adopt these principles as well, Allen said.

Others pointed out potential problems.

Barry Wellman, a University of Toronto sociologist who studies online gatherings, said MySpace still might have difficulty monitoring older users who create underage profiles.

"It's obviously easy to lie in that situation," Wellman said.

Wellman and Avi D. Rubin, a professor at the Johns Hopkins University, said that the agreement that allows parents to submit children's e-mail addresses to MySpace would be useless if kids have multiple addresses.

"Many teens would see that as a challenge to get around rather than a prohibition," Wellman said.

Rubin said, "A teenager can create his own e-mail address that parents don't know about in about two minutes."

And such a database of blocked e-mails would be very valuable information that would be targeted by hackers, Rubin said.

"That would be a database you would know are children," agreed Guilherme Roschke, of the Electronic Privacy Information Center. He said the plan overall contained some good changes, including limiting the ability to use search engines to find private profiles.

The agreement states that MySpace will prohibit tobacco or alcohol advertising, but using algorithms to identify underage users could let someone direct advertising to children, Roschke said.

States sought changes in response to concerns about sexual predators, and the report follows two years of discussions between MySpace and the attorneys general, according to Gansler's office.

Last year, Gansler, a former state's attorney, introduced a statewide program intended to educate children about potential online dangers, including sexual predators and identity theft.

Yesterday's agreement was announced in New York City by attorneys general from New Jersey, North Carolina, Connecticut, Pennsylvania, Ohio and New York.

Investigators have increasingly examined MySpace, Facebook and similar social networking sites that allow people to post information and images on the Web and invite contacts from others.

Last year, New York investigators said they set up Facebook profiles as 12- to 14-year olds and were quickly contacted by other users looking for sex.

The multistate investigation of the sites - announced last year - was aimed at putting together measures to protect minors and remove pornographic material, but lawsuits were possible, officials said.

Porn Business Laying Off Workers

Do we believe this? I know I don't. Read on.

--on the web

Porn Valley [from the LA Times] Last year may have marked the beginning of the end of the Internet's greatest financial success story: hugely profitable pornography. While the mainstream media spent billions of dollars and nearly a decade trying to make a buck off the Internet, the porn industry raked in cash from the moment Al Gore invented the thing.

But with the rise of such free sites as YouPorn (the YouTube of the pornography business), the online subscriber model is imploding. DVD sales are plummeting too, and the adult video business is actually laying off workers (no pun intended). YouPorn is now the most-visited adult site in the world, and its traffic is growing at nearly 40% a month.

Smut's not going away, to be sure. But its industrialization may finally be in retreat.

Porn on the Disney Channel

--on the web

In the year's wrap up of stories, AOL's making a big to-do of a porno incident that happened on the Disney Channel in May of this year:

MIDDLETOWN, N.J. [AP]- A cable television company is investigating just how children in some New Jersey homes ended up watching hardcore pornography when they tuned into a popular cartoon program on the Disney Channel.

Paul Dunleavy, a Middletown, New Jersey, subscriber to cable giant Comcast, was stunned Tuesday morning to find his 5-year-old son watching something other than "Handy Manny," a cartoon show about a bilingual Latino handyman, Manny Garcia, and his talking tools.

"It was two people doing their thing, it was full-on and it was disgusting," the Middletown father of three told The New York Daily News newspaper for its Wednesday editions.

"I couldn't believe it," he said. "We try to do the right thing to protect our kids from this stuff, and then they broadcast it on children's TV."

Dunleavy's phone number was unlisted when The Associated Press tried to contact him Wednesday.

Comcast spokesman Fred DeAndrea confirmed the programming error occurred around 9:30 a.m. Tuesday. He described it as an "isolated issue in a local New Jersey facility."

"We automatically detected the issue and it was corrected promptly. We apologize to any customer who experienced an issue yesterday morning," said DeAndrea, who said the mistake was made by his company, not Disney.

DeAndrea declined to provide the duration of the pornography broadcast, how many homes it reached, how the mistake happened and whether anyone will be disciplined for the X-rated error.

A Disney Channel spokeswoman said the company has asked Comcast for assurances that appropriate measures are taken to prevent such offensive incidents from happening again. The state Board of Public Utilities, which regulates the cable industry in New Jersey, has made a similar request and asked to meet with Comcast officials to discuss the matter.

"We value the trust that parents have in our programming and certainly take yesterday's regrettable program disruption extremely seriously," said Disney Channel spokeswoman Karen Hobson. "Comcast has taken full responsibility for this situation, and we understand that they are currently working to determine the root cause of the incident."

Dunleavy told The Daily News that he received an apology directly from Comcast. But he was still disturbed by the incident. "My son was extremely upset because he thought he'd done something wrong, and we're hoping what he saw doesn't become an issue for him."
